Terms of use
A free app, provided as is, that shows films without streaming any. The account is optional; what you publish on it is your responsibility.
Purpose
CinéSwipe is a free film-discovery app: it shows one film at a time, you skip it or you keep it, it offers you another.
The app can be used entirely without an account. An account is optional: it only serves the community side — publishing lists, commenting, following other members, exchanging messages.
Using the app means accepting these terms. If you do not accept any point of them, do not use the app. There is no subscription to cancel; if you created an account, deleting it is immediate and takes one gesture from the settings.
This English text is a working translation. The French version is the authoritative one.

A free service, provided as is
The app is made available free of charge, as is, without warranty of any kind: no availability, no accuracy, no absence of error, no fitness for a particular purpose.
It may be modified, interrupted or permanently discontinued at any time, without notice and without compensation. No commitment of continuity is given.
No support is guaranteed. You may write to the contact address: an answer is given in good will, not as a contractual obligation.
Third-party content and intellectual property
The posters, images, titles, synopses, ratings, cast lists and trailers shown in the app belong to their respective rights holders: studios, distributors, and the services that broadcast them.
Film details come from TMDB. Availability per platform comes from JustWatch, through TMDB. Trailers are played by the embedded YouTube player. CinéSwipe claims no right over this content and merely displays it for information.
This product uses TMDB and the TMDB APIs but is not endorsed, certified, or otherwise approved by TMDB.
Use of this content remains subject to the terms of its providers, in particular those of TMDB and YouTube. The name CinéSwipe and the design of the app remain the property of the publisher.
The app streams no films
CinéSwipe does not host, store, stream or re-broadcast any film, any series and any trailer. There is no film playback, no download, and no link to an unlawful source.
The app indicates where a film is available and, where applicable, points to the platform concerned. Watching the film requires access to that platform (subscription, rental or purchase), on its terms and at its price.
Trailers are played by the official YouTube player, from YouTube servers, without copying or re-hosting.
Reliability of availability information
Information stating that a film is available on a given platform comes from JustWatch, through TMDB. It is provided for information only.
Catalogues change constantly: a film may have left a platform, moved to rental, or be available only in certain countries and with certain plans. This information may therefore be incomplete, wrong or out of date.
Always check directly with the platform before subscribing, renting or buying. The publisher is bound by none of these indications, and is not liable for a subscription taken out on the strength of information that has since become false.
The publisher has no commercial relationship, partnership or affiliation with the platforms mentioned. Naming them is neither a recommendation nor advertising.
Personal and fair use
The app is intended for personal, private use. It is not intended for professional or commercial use.
In particular, you are asked not to:
- systematically extract, copy or reuse the data displayed, in particular in order to rebuild a film database;
- interfere with the operation of the app or of the third-party services it uses, for example through automated requests;
- circumvent the technical measures of the app or of its providers;
- present the app, or a modified version of it, as approved by TMDB, JustWatch, YouTube or a streaming platform.
The account
Creating an account is restricted to people aged 15 or over. Below that age, the authorisation of a holder of parental responsibility is required, and the account cannot be created alone.
An account is personal. You are responsible for keeping your password confidential and for what is done from your account.
The username must be available and must not impersonate a third party, nor suggest an official connection with a brand, a studio or a platform.
You may delete your account at any time, without justification and without delay, from the settings. Deletion erases the account and everything attached to it.
What you publish
You remain the author of what you publish — lists, descriptions, repost messages, comments, biography, avatar. The publisher claims no ownership of it.
By publishing, you grant the publisher the right to display that content in the app, to the extent necessary for the service to work and according to the visibility settings you chose. That right ends when you delete the content or your account.
You warrant that you have the right to publish what you publish. The following are prohibited in particular:
- unlawful content, and in particular anything inciting hatred, violence or discrimination, anything defamatory, anything harassing a person, and any child sexual abuse material;
- gratuitous pornographic or violent content, unrelated to film discovery;
- content infringing the rights of a third party: copyright, trade mark, image rights, privacy;
- links to sites unlawfully streaming films or series;
- advertising, solicitation, repeated postings and automated content;
- impersonation of a person or an organisation.
Reporting, removal and suspension
Every profile and every comment can be reported from the app, and every member can block another. Reports are reviewed by hand.
The publisher does not monitor content in advance: he has neither a general obligation nor the means to do so. He acts on reports, and on his own initiative where he notices a breach.
Content contrary to these terms may be removed, and the account that published it suspended or deleted. The measure is proportionate: an isolated removal for a one-off lapse, closure for a serious or repeated breach.
You are informed of the removal and of its reason. You may contest it by writing to florian@thibault.tel; the decision is reviewed by a person, and the answer states its reasons.

Your data
Without an account, everything stays with you: the films you keep and your filters are stored on your device. There is no backup on the publisher side — clearing the app data, changing device or uninstalling it is enough to lose them permanently. You can export them from the "Privacy and data" page: that is the only backup possible, and it is yours.
With an account, your email address, your profile and what you publish are stored in a database. Those are backed up by the host and follow you from one device to another.
The films you keep and your filters stay local in both cases: they are never synchronised, even with an account.

Advertising
The app contains no advertising today. If advertising is displayed one day, it will be identified as such and limited to the "Saved films" page.
The publisher is not responsible for the content of the adverts, for the sites they point to, nor for any transaction that might be concluded there.
Liability
As the app is free and provided as is, the publisher cannot be held liable for damage related to its use, in particular: unavailability or discontinuation of the service, errors or omissions in the information displayed, loss of saved films or filters, content and operation of third-party services (TMDB, JustWatch, YouTube, streaming platforms, host).
You use the app under your sole responsibility, on a device and a connection that are your own.
None of these limitations has the effect of excluding liability that cannot be excluded under French law, in particular in the event of gross negligence or wilful misconduct, or of harm to persons.
Changes to these terms
These terms may be amended. The version published in the app is the only one applicable, and the date of the last update appears at the top of the page. Continuing to use the app after an amendment means accepting the new version.
Governing law and disputes
These terms are governed by French law.
In the event of difficulty, write first to florian@thibault.tel: an amicable solution is almost always faster. Failing agreement, the dispute falls to the competent French courts.
If you are a consumer resident in another European Union State, the mandatory provisions of your country of residence that are more protective remain applicable.
